Summary of Illinois’ Workers’ Compensation Landscape
Illinois requires nearly all employers to provide workers’ compensation insurance. The IWCC acts as a strictly adjudicatory body that steps in to resolve disputes between injured workers and employers/carriers; it does not directly administer or pay out benefit funds.
- Reporting Deadline: Notice of an injury must be given to the employer within 45 days of the accident (radiological/asbestosis exposures have longer discovery exceptions).
- Authorized Medical Care: Workers generally enjoy a “two-doctor choice” rule, giving them flexibility to choose their treating physicians unless the employer has a state-approved Preferred Provider Program (PPP).
- Wage Replacement: Temporary Total Disability (TTD) equals two-thirds (66.67%) of the worker’s average weekly wage, starting after 3 missed workdays (retroactively paid if out more than 14 days).
- Key Deadlines & Limits:
- 45 Days: Deadline to report the injury to the employer.
- 3 Years: Statute of limitations to file an official Application for Adjustment of Claim with the Commission (or 2 years from the last compensation payment, whichever is later).
